A Chanute man last week made a first appearance in a case alleging rape.
William Oris McDonald Jr., 55, is charged in Neosho County District Court with rape, a level one felony. Upon conviction, this crime could be punished by a prison term of 147 to 653 months (12 to 54 years), depending on a person’s criminal history.
The complaint alleges that on Saturday, Dec. 14, McDonald had sexual intercourse with a person who was incapable of giving consent because of a mental deficiency or disease.
Chanute police arrested McDonald Saturday in the 300 block of West Walnut Avenue.
McDonald made a first appearance on the charge Tuesday. He will return to court on Jan. 7. He remains jailed.
In other cases: — Freddie L. Heitman, 35, rural Parsons, is charged in Neosho Count with aggravated violation of the Kansas Offender Registration Act. He was convicted of involuntary manslaughter while driving under the influence in a 2010 case, a conviction that requires registration as a violent offender for 15 years. He must register through January 2028, and his registration is current as of Dec. 10. Heitman was driving a pickup on Dec. 13, 2009, on Meade Road two miles east of K-47 and U.S. 59. The passenger side of the vehicle went up the west side bridge rail and rolled over and into a streambed, according to the Kansas Highway Patrol. One of his six passengers, Kayla Walters, 18, was trapped in the vehicle and exposed to the cold water. She later died at Labette Health. Heitman received a suspended prison term and probation. Heitman will return to court on Feb. 4. He is free on bond.
— Kyle W. Ingels, 37, Chanute, is charged in Neosho County with aggravated domestic battery, aggravated robbery, aggravated burglary, all felonies, and intimidation of a witness and criminal restraint, both misdemeanors. The complaint alleges that from Oct. 23 to 29, Ingels broke into an occupied home, impeding the breathing or circulation of a girlfriend and robbed the woman of her car keys. Ingels will return to court on Jan. 21 in Chanute. He remains jailed.
